Recently, a woman from Harlem attended one of these concerts and sampled one of the lipsticks at a pop up shop at the concert venue. Now, she is suing the companies responsible and claiming that she received herpes after she used the lipstick. The 28-year-old plaintiff says that when she was at the Rihanna concert a MAC Makeup specialist applied some of the lipstick to her lips. She wasn’t able to work for two weeks after the concert when her lips became inflamed. Doctors told her she had herpes, an incurable illness. The woman told the Daily News that she was not able to work for two weeks after she showed symptoms of the illness. She says that she wants the makeup professionals to use disposable tubes or swabs to apply the lipstick from now on so that the same thing does not continue happening over and over again. The case is already in the Manhattan Supreme Court, where judges are deliberating as both sides argue back and forth about whether or not this Harlem woman deserves compensation. The woman claims that when she went to the pop up shop, a MAC representative applied the red lipstick to her lips and told her to spread it around. The woman used the same tube of lipstick that she had used with other patrons at the concert. Now, the plaintiff says that MAC should have known that using the same tube of lipstick at a concert with such a large crowd could facilitate the spread of a disease. Now, she is requesting compensation for her mental anguish, and emotional distress due to the incurable illness.
